Buying a House – Getting Started

Miss Piggy and Kermit the Frog finally retire from the Muppet Show and decide to purchase a small oceanfront home in Nova Scotia, where the living is easy and the veterinary care excellent. They hire a local realtor who knows the area and fly up to look at houses.

Miss Piggy, who has very refined tastes, wants to offer on a condo at Bishop’s Landing, but Kermit finally convinces her to offer on a quaint cottage on the Aspotogan Peninsula, complete with its own fresh water pond. The couple sit down with their realtor to make a formal offer by completing an Agreement of Purchase and Sale contract.

This Agreement stipulates the terms of Miss Piggy and Kermit’s offer and includes such standard things as the purchase price and the date they wish to take occupation of the home (the closing date). If Miss Piggy and Kermit’s offer is accepted and the Seller signs the Agreement they present, Miss Piggy and Kermit are legally bound to purchase the property, so the Agreement also includes several standard clauses we call conditions.

Miss Piggy and Kermit will want to make sure they can get financing to purchase the home. They will want to make sure the water is fit for human (in this case animal/reptile) consumption. They will want to bring an inspector in to ensure the house is sound and the septic is working properly. And their lawyer will want to ensure they have good title to the home, meaning they will own it and no one else will have an interest. Miss Piggy and Kermit’s realtor will include all of these clauses and stipulate a date by which these investigations need to be completed, to their satisfaction. If their building inspector discovers that the house is infested with termites, despite this being a good food source for Kermit, they may decide to legally terminate the deal.

But these are standard investigations. As you can imagine, Miss Piggy and Kermit are unique homebuyers, and they have specific concerns that the average buyer may not have. Miss Piggy does not want to buy within a 50km radius of a pig farm, for obvious reasons. And Kermit is a strong frog activist. He wants to know that no frog has ever been harmed or exploited on the property. They need to share these concerns with their realtor, who will add clauses to the Agreement to allow them to terminate the deal if they discover that the owner used to operate a food truck on the lawn during the summer that sold fish and chips and frog legs to the swimmers at Bayswater Beach.

Once Miss Piggy and Kermit have completed the Agreement with the agent they will sign it and the realtor will present it to the Seller’s realtor along with a deposit. If the Seller agrees to accept Miss Piggy and Kermit’s offer they will sign the Agreement, the Parties will be bound and Miss Piggy and Kermit will have to work with their realtor to investigate the conditions they have added to the Agreement before the timelines in the Agreement expire. Once they are satisfied with their conditions the Agreement is firm and they will work towards completing the purchase of the home on the closing date.

Buying a home is exciting stuff! A realtor and lawyer with experience and local knowledge will help protect Miss Piggy and Kermit as they make one of the largest purchases in their lives.

Now if only we could convince them to do one more Muppet Show, say maybe at the Blandford Community Centre…
